Background:


Mr. Peeler is a native of Marietta, Georgia. Mr. Peeler attended the University of Georgia where he received a bachelor of science degree in biochemistry and molecular biology. While in college, Mr. Peeler served as a laboratory research assistant for the University of Georgia's department of biochemistry and molecular biology where his research was focused primarily on applications in the pulp and paper industry.

After graduating from college, Mr. Peeler worked for the industrial chemicals and solvents division of Ashland Chemical Company (a division of Ashland Oil) where he served as a technical sales representative. At Ashland, Mr. Peeler's duties included assisting customers (primarily in the textile, paper and automotive industries) with identifying and fulfilling chemical requirements, complying with environmental regulations, and identifying and testing alternative chemicals for use in industrial processes.

Mr. Peeler is a cum laude graduate of the University of Georgia School of Law. While in law school, Mr. Peeler was a member of the Moot Court Society where he obtained an award for best brief. Mr. Peeler was also a member of the editorial board for the Journal of Intellectual Property Law, the Henry Joseph Lumpkin Inn of Court, Blue Key Society, Omicron Delta Kappa, and was president of his graduating class. During law school, Mr. Peeler also took and passed the United States Patent and Trademark Office bar examination.

Following law school, Mr. Peeler went to work in Atlanta, Georgia for the law firm of Jones & Askew, the southeast's leading intellectual property law boutique. While at Jones & Askew, Mr. Peeler represented Fortune 100 clients in patent, copyright and trademark litigation matters. Mr. Peeler also represented clients before the United States Patent and Trademark Office in obtaining United States patents and trademark registrations.

In 2001, Mr. Peeler joined the intellectual property group of King & Spalding, LLP in Atlanta, Georgia. There, Mr. Peeler gained significant experience litigating patent, copyright, trademark, trade secret and unfair competition matters. While at King & Spalding, Mr. Peeler also developed a significant pro bono practice representing indigent defendants in criminal law matters. While in Atlanta, Mr. Peeler also donated his time assisting Habitat for Humanity with real estate legal matters.

On June 1, 2005, Mr. Peeler and Patrick S. Flynn formed the law firm of Flynn & Peeler, LLC in Albany, Georgia. At Flynn & Peeler, Mr. Peeler will continue his practice representing clients across the United States in the areas of commercial litigation and patent, copyright, and trademark law matters.

Mr. Peeler's practice includes commercial litigation and patent, copyright, trademark and trade secret law. Registered to practice before the United States Patent and Trademark Office, Mr. Peeler also has significant experience counseling clients on a wide range of intellectual property issues, including preparing patentability and infringement opinions, managing intellectual property diligence efforts during merger, acquisition and equity investment transactions and obtaining patents in the United States and around the world.

  • Representing a financial institution before the Office of Thrift Supervision in the acquisition of an insurance agency;

  • Defending a client in the chemical industry in an action alleging claims of copyright infringement, trademark infringement and misappropriation of trade secrets;
  • Enforcing a client's trade secrets against a competitor in the ice cream industry;
  • Enforcing a client's trademark against a competitor in the carpet industry;
  • Protecting the misappropriation of a Chief Executive Officer's name and likeness in the fast food pizza industry;
  • Defending a national retailer in an action alleging trademark infringement, copyright infringement, and counterfeiting in the salon only shampoo industry;
  • Managing intellectual property diligence efforts for a client in its purchase of a chemical company;
  • Procuring United States and international patent portfolios for clients in the software, paper, polymer and pharmaceutical industries;
  • Protecting a politician's name from being misappropriated as a domain name;
  • Negotiating non-disclosure agreements for a client in the textile industry;
  • Representing a client in the heavy equipment industry in an action for defamation, trademark infringement and unfair competition.
